EngagePlus Limited owns and operates EngagePlus, a proprietary signature platform that offers subscription-based services primarily for learning institutions. The content, pages, and infrastructure of the EngagePlus website are provided for Your personal non-commercial use only. You are strictly prohibited from engaging in any commercial or competitive activity or purpose, including but not limited to reselling, deep-linking, copying, monitoring, displaying, downloading, or reproducing any content, information, software, products, or services available on our website.

 

Collection and Processing of Personal Data

By using the Service, You acknowledge and consent to the collection, storage, and processing of Your personal data in accordance with EngagePlus's Privacy Policy.

 

Compliance with Applicable Laws

You agree to use the Service in compliance with all applicable laws, regulations, and third-party rights. You are responsible for ensuring that Your use of the Service does not infringe upon the rights of others.

 

Relationship with Education Providers

When You make a reservation or booking through EngagePlus, You enter into a direct and legally binding relationship with the Education Provider from which You reserve or book. EngagePlus acts solely as an intermediary, transmitting reservation details, sending confirmatory emails on behalf of the Education Provider, and processing payments. All reservations and bookings are subject to the Standard Booking Terms and Conditions between the Education Provider and the User. Additional terms and conditions set by the Education Provider will also apply, and You are advised to review them thoroughly before making a booking.

 

Cancellation, Rescheduling, and Refund Policy

By making a booking, You agree to be bound by the Education Provider's terms of cancellation, rescheduling, and refund policy. In the absence of any specific terms by the Education Provider, no refunds will be given, and rescheduling will not be allowed. EngagePlus may provide support for rescheduling as permitted by the Education Provider's terms. Any refund disputes shall be resolved directly between You and the Education Provider, with EngagePlus offering initial support and issuing refunds if appropriate.

 

Payment Processing and Taxes

When You make a payment through the EngagePlus system, it is processed securely online. EngagePlus Limited shall not be responsible for withholding or paying any taxes that You or the Education Provider are legally obligated to pay.

 

Communication and Review Requests

By completing a booking or reservation, You consent to receiving emails from EngagePlus regarding Your booking or reservation. These emails may provide information about Your course, offer relevant information and third-party offers (if You have opted in), and invite You to complete review forms after participating in the Educational Offering.

 

Information Accuracy and Liability

EngagePlus provides information based on details provided by Education Providers. While EngagePlus uses reasonable skill and care in performing its services, it does not verify or guarantee the accuracy, completeness, or correctness of all information displayed on the platform. Education Providers are responsible for ensuring the accuracy of their displayed information. EngagePlus does not endorse or recommend any Education Provider or Educational Offering unless explicitly stated.

 

Disclaimer of Warranties

EngagePlus does not warrant that the Service will be error-free, uninterrupted, or free from viruses or other harmful components. Your use of the Service is at Your own risk.

 

Limitation of Liability

In no event shall EngagePlus Limited or its shareholders, affiliates, directors, officers, subsidiaries, employees, suppliers, or assigns be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with Your use of the Service, even if EngagePlus has been advised of the possibility of such damages.

 

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region.Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.

 

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

 

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire Agreement between EngagePlus and You, superseding any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
